James Drnec

Jim Drnec has significant litigation experience representing a broad spectrum of healthcare providers, including staff, nurses, physicians, hospitals, and professional practice groups in legal matters ranging from premises liability to professional liability. He has served as trial counsel in such matters before the Delaware Superior Court in New Castle, Kent, and Sussex Counties and has successfully handled appellate issues addressed to the Delaware Supreme Court, the Third Circuit Court of Appeals and the United States Supreme Court. Mr. Drnec has provided representation for hospitals, and numerous individual nurses, staff members, and doctors including radiology technicians, family practitioners, anesthesiologists, neurosurgeons, cardiologists and ob-gyns.

In addition to success at trial, Mr. Drnec’s representations have also resulted in legal opinions favorable to the medical community, including:

  • Myers v. Medical Ctr. Del., C.A. No. 03-2375, United States Court of Appeals for the Third Circuit, 200 U.S. App. LEXIS 15742 (May 25, 2004) (Affirming summary judgment in favor of medical providers on wrongful death claim);
  • Atamian v. Hawk, 842 A.2d 654 (Del. Super. 2003), aff’d (Del. 2004), cert. denied, No. 03-10106, U.S. S. Ct. (2004) (Premises Liability/Civil Rights);
  • Woulard v. Brown, C.A. No. 01-350, 2004 U.S. Dist. LEXIS 3100 (D. Del. Feb. 24, 2004) (Granting summary judgment against plaintiff);
  • Hamleton v. Christiana Care Health Services, Inc., C.A. No. 97C-12-044 (Del. Super. Jan. 31, 2002) (Granting motion to preclude plaintiff’s use of defense expert).
